1. Your Relationship with Us:
Welcome to Dr. Blue which is provided by
Fekra for Electronic Solutions Ltd.
You are reading the terms of service (the
“Terms”), which govern the relationship and
serve as an agreement between you and us
in which therapy will be provided and set
forth the terms and conditions by which you
may access and use the Platform and content
(collectively, the “Services”). Our Services are
provided for private, non-commercial use.
For purposes of these Terms, “you” and
“your” means you as the user of the Services.
Disclaimer these Terms form a legally binding
agreement between you and us. Please take
the time to read them carefully.
2. Accepting the Terms:
By accessing or using our Services, you
confirm that you can form a binding contract
with us meaning that you accept these Terms
and that you agree to comply with them. the
terms of which can be found directly on the
Platform, or where the Platform is made
available for download, on your mobile
device’s applicable app store, and are
incorporated herein by reference. By using
the Services, you consent to the terms of the
Privacy Policy.
You can accept the Terms by accessing or
using our Services. You understand and agree
that we will treat your access or use of the
Services as acceptance of the Terms from
that point onwards.
You should print off or save a hard copy of
the Terms for your records.
3. Your Subscription and session
bookings:
To make the payment process as convenient
as possible for you, we have opted for a
modern and efficient payment method. In
exchange for our services, we require
payment via e-wallet. This method provides a
secure and seamless transaction process,
ensuring that your experience with us is as
smooth and hassle-free as possible.
Our therapy sessions are designed to be
effective and efficient, and therefore each
session with your chosen therapist will be
lasting anywhere from 35 to 60 minutes in
length. This time frame has been carefully
chosen to ensure that you have adequate
time to engage in a meaningful dialogue with
your therapist and work towards your goals.
Please be aware that sessions will start and
end promptly at the designated time, and
any late joining may result in a shorter
session. If you have any questions or
concerns regarding the length of our therapy
sessions, please do not hesitate to contact us
for further information.
We understand that life can be
unpredictable, and sometimes you may need
to cancel your therapy session. However, in
order to ensure that we are able to provide
the best service possible to all of our clients,
we require that you cancel your session with
at least 24 hours’ notice prior to the
scheduled start time.
If you fail to cancel within this time frame, we
reserve the right to deduct 30% of the
session fee as a cancellation fee. This is
necessary to compensate our therapists for
the time that they have set aside for your
session, and to ensure that our services are
available to other clients who may be in need
of support.
We appreciate your understanding and
cooperation in this matter, and we
encourage you to reach out to us if you have
any questions or concerns regarding our
cancellation policy. Our goal is to provide you
with the best possible therapy experience,
and we are committed to working with you
to achieve your goals.
We reserve the right to change our
subscription options and adjust the prices of
our services. In the event of any changes, we
will notify you in advance.
Occasionally, we may offer free trials for our
services. After the trial period ends, your
membership will automatically convert to a
paid membership, and you will be notified of
the change. Please note that free trials are
available only to new customers.
4. Your account, representation,
conduct and commitments with us:
You hereby confirm that you are legally able
to consent to receive Services, or have the
consent of a parent or guardian, and are
legally able to enter into a contract.
Minor Consent: Where consent from a
parent or guardian is required to receive
services as stipulated in applicable Libya
laws, you hereby confirm that as the
consenting parent or guardian, you have the
sole right to consent to services for the minor
seeking therapy and are not legally
mandated to confer with or get consent from
any other legal guardian before consenting.
You also give affirmative consent that the
services remain valid until membership is
canceled.
We take the accuracy and completeness of
the information you provide very seriously,
as it impacts the quality of the services, we
are able to offer you. Therefore, we urge you
to promptly update any changes to your
information, such as contact details, payment
information, or health history, to ensure that
we can continue to provide you with the best
possible service.
You agree, confirm and acknowledge that
you are responsible for maintaining the
confidentiality of your password and any
other security information related to your
account, we advise you to change your
password frequently and to take extra care in
safeguarding your password.
You agree to notify us immediately of any
unauthorized use of your account access or
any other concern for breach of your account
security.
You agree, confirm and acknowledge that we
will not be liable for any loss or damage that
incurred as a result of someone else using
your account, either with or without your
consent and/or knowledge.
You agree, confirm and acknowledge that
you are solely and fully liable and responsible
for all activities performed using your
account. You further acknowledge and agree
that we will hold you liable and responsible
for any damage or loss incurred as a result of
the use of your account by any person
whether authorized by you or not, and you
agree to indemnify us for any such damage
or loss.
By using the Platform, you confirm and agree
that you are using it for your personal use
only, and not on behalf of any other person
or organization. You may not use the
Platform to conduct any commercial or
business activities, or to promote or
advertise any products, services, or events.
If you receive any file from us or from a
therapist, whether through the Platform or
not, you agree to check and scan this file for
any virus or malicious software prior to
opening or using this file.
You confirm and agree to use only credit
cards or other payment means (collectively
“Payment Means”) which you are duly and
fully authorized to use, and that all payment
related information that you provided and
will provide in the future, to or through the
Platform, is accurate, current and correct and
will continue to be accurate, current and
correct.
You are responsible for paying all fees and
charges associated with your Account in a
timely manner, in accordance with the fees
schedule and rates stated on the Platform. By
providing us with your Payment Means, you
authorize us to bill and charge you through
that Payment Means. You also agree to
maintain accurate and up-to-date Payment
Means information in your Account.
In the event of any billing errors or
discrepancies, please notify us immediately.
Failure to pay any fees or charges when due
may result in the suspension or termination
of your access to the Platform.
Please note that we may change our fees and
rates from time to time, and any such
changes will be communicated to you in
advance. By continuing to use the Platform
after such changes, you agree to be bound by
the updated fees and rates.

5.The Therapist Services:
Please note that the Therapists who provide
their services through our Platform are
independent providers, and are not
employees, agents or representatives of our
company. Our role is limited to facilitating
access to the Therapist Services through our
Platform. The therapists themselves are
solely responsible for the performance of the
Therapy Services.
In the event that you feel the Therapy
Services provided by your therapist do not
meet your needs or expectations, you have
the option to switch to a different Therapist
available through our Platform. However,
please be aware that not all Therapists listed
on our database may be available for you to
match with.
Should your therapist stop using our Platform at
any time after you have been connected, we will
send you an email notifying you of the change
and provide you with the opportunity to match
with a new Therapist.
While we strive to provide Therapy Services that
are beneficial to all users, we understand that
they may not be the appropriate solution for
everyone’s needs or every situation. Additionally,
Therapy Services may not be a complete
substitute for a vis-à-vis session and/or care in
certain situations.
It is important to note that the therapists are not
licensed to prescribe medication or drugs, and
therefore, we do not offer this service through
our platform. As a user of our service, you agree
that you will not use this platform to request or
obtain prescription medication or drugs from any
of our therapists.
We take this matter very seriously and any
attempt to solicit medication or drugs through
our platform will result in immediate termination
of your account and may be reported to the
appropriate authorities.
Our goal is to provide you with a safe and
supportive environment for your therapy
sessions, and we appreciate your cooperation in
helping us to maintain the integrity of our
platform. If you have any questions or concerns
about this policy, please do not hesitate to
contact us.
6. Protecting your Information:
At our Platform, we take the security and
privacy of your personal information very
seriously. We guarantee that your account
information, including your login details, will
remain confidential and will not be shared
with anyone unless we have reason to
believe that there has been a serious breach
of our terms of service or a violation of the
applicable laws or/and Libyan legislations in
force.
We use advanced security measures to
protect your data and regularly update our
systems to ensure that they are up to date
with the latest industry standards. We also
require that all of our contractors adhere to
strict security and confidentiality protocols to
prevent any unauthorized access or
disclosure of your information.
If you have any concerns about the security
of your account information or any other
aspect of our service, please do not hesitate
to contact us. We are committed to providing
you with a safe and secure platform for your
therapy sessions.
7. Complaints:
As a condition of our service agreement, you
are required to promptly notify us of any
concerns or complaints regarding your
therapist’s work. Failure to do so may result
in forfeiture of your entitlement to any
compensation. Your feedback is valuable to
us and we encourage you to speak up so that
we may address any issues in a timely
manner.
8. Prohibited Activities:
You may not use the Service for any other
purpose than that for which Dr. Blue makes it
available. Dr. Blue reserves the right in its
sole discretion to investigate, terminate your
membership and take appropriate legal
action if you violate this provision or
otherwise misuse the Service, or behave in a
way which we deem as inappropriate or
which is unlawful or illegal in Libya.
You will not collect or gather other people’s
personal information (including account
information) from the Service.
The following is a list of the type of actions
that you may not engage in with respect to
the Service:
You will not use the Service for any illegal
purpose, including engaging in any criminal
or tortious activity.
You will not use any robot, spider, site
search/retrieval application, or other manual
or automatic device or process to retrieve,
index, “data mine”, or in any way reproduce
or circumvent the navigational structure or
presentation of the Service or its contents.
You will not post, distribute or reproduce in
any way any copyrighted material,
trademarks, or other proprietary information
unless under fair use or without obtaining
the prior consent of the owner of such
proprietary rights.
You will not remove any copyright,
trademark or other proprietary rights notices
contained in the Service.
You will not interfere with or disrupt the
Service or the servers or networks connected
to the Service.
You will not post, email or otherwise transmit
any material that contains software viruses
or any other computer code, files or
programs designed to interrupt, destroy or
limit the functionality of any computer
software or hardware or telecommunications
equipment and files that contain viruses,
trojans, worms, logic bombs or other
material that is malicious or technologically
harmful .
You will not manipulate identifiers in order to
disguise the origin of any information
transmitted through the Service.
You will not “frame” or “mirror” any part of
the Service, or otherwise take elements of
the Service and reformat or display them.
You will not modify, adapt, sublicense,
translate, sell, reverse engineer, decipher,
decompile or otherwise disassemble any
portion of the Service or any software used
on or for the Service or cause others to do so.
Or any other activities that are deemed
unlawful under the Libyan anti-cybercrime
Law No. 5 of 2022 and the Libyan Penalty
code of 1954.
We take the integrity and safety of our
platform very seriously and will not tolerate
any misuse or abuse of the Platform. We
reserve the right to investigate and take
appropriate legal action against any user who
violates these terms.
9. Updating These Terms:
We may amend our Service and policies from
time to time, and we may need to make
changes to these Terms so that they
accurately reflect our Service and policies.
Unless otherwise required by law, we will
notify you (for example, through our Service)
before we make changes to these Terms and
give you an opportunity to review them
before they go into effect. Then, if you
continue to use the Service, you will be
bound by the updated Terms.
10. Modifications, Termination,
Interruption and Disruptions to the
Platform:
You acknowledge and agree that we reserve
the right to modify, suspend, disrupt, or
discontinue the Platform, in whole or in part,
with or without notice to you, and this may
affect all clients or only you individually. You
understand that we cannot be held
responsible for any losses or damages
incurred as a result of these actions.
Additionally, as the reliability and
accessibility of the Platform depend on
multiple factors, including software,
hardware, and tools, we make every effort to
ensure its reliability and accessibility.
However, you acknowledge that no platform
can be 100% reliable and accessible and
therefore we cannot guarantee
uninterrupted access or error-free services at
all times. Despite this, we strive to maintain
the highest standards and will continue to
work towards improving the Platform’s
performance.
11. Governing Law:
Any legal dispute referring or relating to the
agreement between the parties shall be
governed in accordance with the laws in
Libya. By accepting this ToS you agree to
submit to the exclusive jurisdiction of the
courts located in Libya
